Before you appeal
Appeals to the First-tier Tribunal for Scotland (General Regulatory Chamber) in police cases can only be brought by a police constable who is dissatisfied with a formal decision taken under one of the following:
- The Police Service of Scotland (Conduct) Regulations 2014
- The Police Service of Scotland (Senior Officers) (Conduct) Regulations 2013
- The Police Service of Scotland (Performance) Regulations 2014
- The Police Service of Scotland (Senior Officers) (Performance) Regulations 2016
You must have received a written decision, usually following a misconduct hearing or performance hearing, before an appeal can be made.
Appeals can only be made on certain statutory grounds, and the Tribunal cannot revisit matters of policy or re-hear the entire disciplinary or performance process unless appropriate.
